Terms of Service

1. Acceptance of Terms

By accessing or using the website and services of BuildMyStore.lk, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("the Client") and BuildMyStore.lk ("the Service Provider").

2. Description of Services

BuildMyStore.lk provides website creation services to small businesses and individuals in Sri Lanka. We offer three service plans:

Free hosting is included for the first year on all plans. After the first year, hosting fees will be communicated to the Client in advance.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate, complete, and truthful information required to deliver the services
• Ensure you have the right to use any content, images, or materials you provide for your website
• Comply with all applicable laws, including Sri Lanka's Personal Data Protection Act (PDPA) and any other relevant regulations
• Ensure your website content does not infringe on any third-party intellectual property rights
• Respond to queries and provide feedback within a reasonable timeframe to meet project timelines
• Pay all fees on time as agreed upon in the service agreement

4. Intellectual Property

Your Content: You retain full ownership of all content, images, text, and materials you provide for your website. You grant BuildMyStore.lk a limited license to use these materials solely for the purpose of delivering the agreed services.

Website Design & Structure: The design, layout, code structure, and framework created by BuildMyStore.lk for your website remain the intellectual property of BuildMyStore.lk unless otherwise agreed in a separate written agreement. Upon full payment, you receive a license to use these elements for your own website.

BuildMyStore Branding: We reserve the right to display your website (or portions thereof) in our portfolio and marketing materials unless otherwise agreed in writing.

5. Payment Terms

• Full payment is required before project commencement, unless otherwise agreed in writing.
• All fees are non-refundable once the project has commenced.
• Payment can be made via bank transfer, Koko Pay, Payhere, or as otherwise communicated.
• All prices are listed in Sri Lankan Rupees (LKR) and are exclusive of applicable taxes unless stated otherwise.

6. Project Scope & Revisions

• The agreed project scope is defined by the selected service plan. Additional features or pages beyond the selected plan may incur extra charges.
• A reasonable number of revision rounds are included as part of your plan. Significant design changes or scope expansions may incur additional fees.
• Project timelines commence from the date of receipt of full payment and all required content from the Client.

7. No Commission on Sales

BuildMyStore.lk does not charge any commission on sales made through your website. The fees charged are solely for the website creation and hosting services.

8. Limitation of Liability

To the fullest extent permitted by law, BuildMyStore.lk shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with our services.

Our total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific service in question.

9. Termination

• By Client:You may terminate our services at any time by providing 30 days' written notice. No refunds will be issued for work already completed.
• By BuildMyStore.lk: We may terminate services with immediate effect if you breach these Terms, provide false information, or engage in unlawful activities.
• Effect of Termination: Upon termination, all pending payments become immediately due. We will deliver completed work as of the termination date.

10. Prohibited Use

You may not use our services to create a website that:

• Promotes illegal activities or violates any law
• Infringes on intellectual property rights of any third party
• Contains defamatory, obscene, or offensive content
• Distributes malware, viruses, or other harmful code
• Engages in fraudulent or deceptive practices
• Violates the policies of our payment processors (Koko Pay, Payhere)

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to These Terms

We reserve the right to revise these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
